Terms of Service
These terms are written for the website, customer marketplace, project planning tools, render tools, fabricator workflows, and any mobile or tablet apps published through The Countertop Club.
Summary
- The platform helps users browse materials, plan projects, request quotes, and coordinate fulfillment.
- Marketplace images, renders, drawings, AR views, and layouts are reference and visualization tools, not final guarantees.
- Third-party fabricators, installers, and suppliers remain responsible for their own work and schedules.
- Your use of the website and future apps is subject to these same core terms unless a product states otherwise.
1. Agreement to Terms
These Terms of Service apply to the website, customer portal, slab marketplace, planning tools, render tools, fabricator workflows, and any mobile or tablet applications published by or presented through The Countertop Club (collectively, the "Services").
This includes current and future apps presented by TheCountertopClub.com, including CounterRender AI, CountertopClub AR, Counter AR.
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility and Accounts
You must be at least 18 years old and able to enter a binding agreement to use the Services.
You are responsible for your account credentials, device security, and all activity that occurs under your account.
You agree to provide accurate information and keep your account, billing, shipping, and project details reasonably current.
3. Platform Role
The Countertop Club LLC operates a software, marketplace, and coordination platform. Unless explicitly stated otherwise in writing, we are not the direct fabricator, installer, carrier, or manufacturer of listed materials.
Independent third-party fabricators, installers, suppliers, freight providers, and service providers may participate in fulfillment. Their work, schedules, methods, and outcomes remain their responsibility.
4. Marketplace Listings and Product Variation
Material images, swatches, renders, descriptions, and slab previews are planning and merchandising tools. Natural and engineered materials can vary by lot, finish, lighting, veining, movement, texture, and tone.
Availability, price, and lead times may change before final order confirmation.
5. Drawings, Renders, Layouts, and Estimates
Drawings, slab layouts, fit checks, render outputs, kitchen previews, augmented reality views, estimates, and related planning tools are provided for reference, illustration, and general visualization purposes only. They are not final engineering, fabrication, architectural, or installation instructions.
Visual outputs are intended to help users evaluate style direction, approximate fit, and general design concepts. They are not representations, warranties, or guarantees that the final fabricated, installed, delivered, or photographed result will match the digital output in color, scale, proportion, finish, seam placement, lighting response, edge visibility, reflections, veining, pattern movement, or overall appearance.
Actual results may differ, and in many cases will differ, due to lot variation, material availability, screen settings, photography conditions, site conditions, fabrication methods, tolerances, seam strategy, edge execution, field measurements, substrate conditions, adhesives, lighting, and installation decisions.
Final field verification, seam placement, overhang decisions, sink fit, edge details, tolerances, substrate requirements, and installation suitability must be confirmed by the responsible fabricator or installer.
6. Orders, Pricing, and Payments
You agree to pay approved purchase amounts, taxes, fees, shipping, storage, and any additional charges caused by scope changes, reselection, insufficiency, special handling, or downstream fabrication requirements.
Quotes and estimates may change if availability changes, selected quantity is insufficient, site conditions differ, measurements change, or supplier costs move before final approval.
Payment processing may be handled by third-party providers. Separate processor terms may apply.
7. Cancellations, Returns, and Refunds
Cancellation, refund, and return rights depend on order stage, supplier policy, custom work status, and costs already incurred.
Custom fabrication, templating, cut materials, special-order materials, and work already scheduled or performed are generally non-refundable unless required by law or expressly agreed in writing.
Outlet, remnant, and clearance materials are sold AS IS and may not be returnable.
8. User Content and Uploads
You are responsible for files, photos, plans, measurements, and other content you upload. You represent that you have the right to provide that content and that it does not violate the rights of others.
You grant us a non-exclusive right to host, process, display, copy, and share that content as needed to operate the Services, support your project, improve feature quality, and coordinate with relevant service providers.
Do not upload sensitive data you do not want used for project fulfillment or support.
9. App Use and Device Features
If you use our mobile or tablet apps, you may be asked to grant permissions such as camera, photo library, files, or notifications. Those permissions are optional except where required for a feature you choose to use.
You may remove app permissions through device settings, but some features may stop working correctly.
App Store, Google Play, or other platform terms may also apply to your download and use of our apps.
10. Prohibited Conduct
You may not use the Services to commit fraud, interfere with the platform, scrape protected content, bypass access controls, upload malicious files, abuse other users, or misrepresent project, payment, or business information.
We may suspend or terminate access for abuse, risk, non-payment, legal concerns, policy violations, or conduct that threatens users, vendors, or the platform.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, exact render fidelity, exact marketplace availability, or error-free outputs.
We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, except where those disclaimers are not permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, The Countertop Club LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, delay damages, lost data, or third-party workmanship disputes.
Our total liability for a claim relating to the Services is limited to the amount you paid directly to us for the transaction giving rise to the claim during the 12 months before the claim arose.
13. Indemnity
You agree to defend, indemnify, and hold harmless The Countertop Club LLC and its affiliates, officers, employees, and service providers from claims, liabilities, damages, losses, and expenses arising from your use of the Services, your uploads, your orders, or your violation of these Terms.
14. Suspension and Termination
We may suspend or terminate access to the Services at any time if needed to protect the platform, comply with law, reduce fraud or payment risk, or respond to material violations of these Terms.
Sections that by their nature should survive termination, including payment, limitation of liability, dispute, and intellectual property provisions, will survive.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict of laws rules.
Unless applicable law requires otherwise, disputes must be brought in Spokane County, Washington.
16. Changes to the Services or Terms
We may change or discontinue features, tools, workflows, or pricing at any time.
We may also update these Terms. If we make material changes, we may post updated terms in the Services and update the effective date. Continued use after changes are posted means the revised Terms apply going forward.
